A series of protests began to be called in Brazil, after a Brazilian soccer businessman, accused of rape a young girl influencer, was acquitted because the Justice considered that there was no “fraud”, that is to say, intention to commit the crime.
The decision was determined by the justice in mid-September of this year, in a process that was carried out under summary secrecy, but this Tuesday the news site “The intercept” disclosed exclusive images of the judgment and the way the young woman was treated in the process, something that even Supreme Court magistrates have described as “terrifying.”
The facts refer to a complaint of rape filed by Mariana ferrer, a 23-year-old influencer, who claims to have suffered sexual abuse by businessman André de Camargo Aranha, without his consent in December 2018 during a party in Florianápolis (south).
The first prosecutor who took the case, identified the accused as guilty of “violation to vulnerable”, a decision that was overturned after an appeal filed by the defense.
When the case was resumed, there was a change of prosecutor and the new accuser determined that there was no way to prove that Ferrer was not in a position to consent to the sexual act and therefore, according to the prosecutor, there was no “intention” to rape.
Thus, according to The Intercept, which had access to the sentence, the businessman was accused of “guilty rape”, a crime that is not provided for in Brazilian law and as it does not exist, it was acquitted of the charges.
According to the images revealed by The Intercept, the young woman was labeled a liar and humiliated by the defense attorney, as acknowledged by Supreme Court magistrate Gilmar Mendes in a message published today on his social networks.
He also revealed photographs that he described as “gynecological” and that had no relation to the process, since they were taken years before, when Ferrer was working as a model. During the process, the young woman even asked the judge for clemency: “Your Excellency, I ask for respect not even from the accused They are treated like me, for the love of God, “he said.
Outrage across the board
The images that revealed the details of the trial were qualified by Magistrate Méndes as “terrifying”.
“The scenes in the Mariana Ferrer audience are terrifying. Justice must be an instrument of welcome, never of torture and humiliation. The correctional bodies must determine the responsibility of the agents involved, including those who did not act, “he said.
The verdict of the trial and the harshness with which the young woman was treated raised a blister in the country and flooded social networks with messages of I support the young influencer, while protests were called for the next few days.
Under the hashtag #nojento (disgusting), which became a trend, citizens, entertainment people, politicians and even football teams like him Flamengo, Sao Paulo and Vasco da Gama they reacted against the judge’s decision.
