The judicial revolt at the closure of Madrid and nine other municipalities in the region ordered by the Government has plunged citizens into a morass of uncertainty and confusion that no Administration has managed to resolve. On the eve of bridge of October 12, in which up to 1.5 million people usually leave the capital, nobody knows what to expect.
The situation has been so bizarre that even the regional president, Isabel Díaz Ayuso, who had appealed the perimeter confinements before the National Court, joined the mayor José Luis Martínez-Almeida in his request to the people of Madrid that “do not travel“It was in Ayuso’s hands to shorten the uncertainty and set a new course on Thursday afternoon, agreeing to convene the meeting of the Covid-19 Group, in coordination with the Government, which had been requested by the Minister of Health, Salvador Illa, to agree on a dialogue solution to the situation.
The basic zones
But the president, despite having offered dialogue in an institutional statement without questions, he has delayed the meeting to this Friday. At the meeting, in addition, the Minister of Health was going to put on the table a new order already drawn up that in principle would include only restrictions linked to the basic health zones, as it had done previously. These limitations would take effect this Friday.
On the other side of the table the Minister of Health had to sit. He asked to meet on Thursday afternoon, hours after the Superior Court of Justice of Madrid knock down the perimeter closure of Madrid capital and nine other cities, but given the attitude of those in charge of Madrid to draw up their own order and delay the meeting one day, the Government decided late on Thursday to send a ultimatum to Ayuso: either she applies the restrictions or the state of alarm.
The Superior Court of Justice of Madrid (TSJM) has denied only the restrictions of mobility, those that prohibited entering or leaving the municipalities of Madrid, Móstoles, Fuenlabrada, Alcobendas, Alcalá de Henares, Torrejón de Ardoz, Parla, Getafe, Alcorcón and Leganés, considering that they affected Fundamental rights.
The judicial interpretation
In the absence of an interpretation of the auto [aquí en PDF] On the part of the competent Administration, the Community of Madrid, judicial sources have pointed out that the rest of the order remains intact. Therefore, the closing of the bares and restaurants at 11:00 p.m. and shops at 10:00 p.m., as well as the reduction of capacity to 50% in all establishments and the prohibition of consumption in bars, still valid in those ten municipalities.
The 45 sanitary zones that Ayuso had confined are again so, according to the same sources, although no one has been in charge of informing those affected. Limiting meetings to a maximum of six people It is also still in force since it has not been affected at any time by the Health Order.
The turnaround in the situation especially affects people who had canceled tickets plane, train or accommodation reservations, but also to the owners of bars and shops, who after the court order did not know how to serve customers. In the streets the overturning began to be noticed with the removal of the controls that the Government Delegation had installed, for example, on Paseo de la Castellana.
The situation will take a new turn with the answer that Ayuso gives to Pedro Sanchez, but the restrictions lifted by the judicial order will be implanted again by one way or another.
Call to responsibility
Fernando Simón, the technical spokesman for the Government in the pandemic, appealed to the responsibility of the people of Madrid so that don’t go out of bridge. “Mobility restrictions are established so that people from territories with the highest incidence do not extend their contagion to the territories with less and in Madrid this is still very high, one of the highest in Europe, “he warned.
Ayuso had proclaimed in his statement that the measures launched by his Executive weeks ago were bearing fruit and “that is why the contagion index of Madrid capital is already at 465, below the order of the Government itself, and at 507 on average in the Community”.
Without entering into a new war of numbers, Simón made it clear that the incidence data of the most recent days are not reliable, due to the delays in the notifications since in the data from a week ago a certain stabilization of contagions, but not the abrupt fall that the autonomous government proclaims.
Díaz Ayuso announced in his institutional statement that he will withdraw the precautionary measures presented in the National audience against the partially suspended order “to avoid further confusion for citizens.” Quite a detail.
